6th Circuit Court of Appeals Finds Fair Use Is For Jury To Decide

The 6th Circuit Court of Appeals has held that the copyright fair use defense is a question for the jury, not for the judge.  This question most recently arose in the MPAA case Sony v. Tenenbaum, where the court asked whether fair use was treated as an equitable defense and, as such, should be decided by a judge and not a jury.  William Patry, counsel for Google and author of the Patry on Copyright Treatise and Moral Panics and the Copyright Wars, has argued that fair use is not an equitable defense and that it is a question properly left for the jury.  The 6th Circuit holding means that fair use in Michigan copyright cases will be decided by a jury and not by a judge.  If you need a Michigan copyright lawyer to assert your fair use defense to a jury, contact one of our expert Michigan copyright lawyers today at 866.936.7447.
